Terms of service

The agreement between you and Wary Tech Ltd for the use of WaryMail.

Last updated 2026-09-07.

1. Who this is between

These terms are between Wary Tech Ltd (“we”, “us”), a company incorporated in England and Wales, and the organisation or person who creates a WaryMail workspace (“you”). Using the service means accepting them. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it.

2. The service

WaryMail is a hosted workspace that connects to mailboxes you already control, indexes their metadata, displays and sends mail on your behalf, and provides tracking, follow-up and collaboration features. It is not a mail host: we do not run your mail server, we do not accept mail for your domain, and we are not the only copy of your mail.

3. Your account

  • You are responsible for the accuracy of the details you give us and for keeping your credentials secret.
  • Each person using a workspace must have their own account. Shared logins are not permitted.
  • You are responsible for what the members of your workspace do with it, including the mailboxes they connect.
  • You must have the right to connect each mailbox you connect and to send from each address you send from.
  • We may suspend an account where we reasonably believe it is compromised, being used unlawfully, or in breach of the acceptable use policy. Where practical we will tell you first, and we will always tell you why.

4. Your content

Your mail, contacts and files remain yours. You grant us only the permission needed to provide the service: to receive, store, index, display, transmit and back up that content, and to have our sub-processors do the same. We do not sell it, we do not use it to train machine-learning models, and we do not use it for advertising.

5. Trials, fees and payment

  • Trials run for the period stated when you sign up. We do not charge for a trial and do not require a card to begin one.
  • Subscriptions are billed in advance for the period you choose, per user, in the currency shown at checkout.
  • Prices exclude VAT and any other tax that applies where you are; those are added at checkout where required.
  • Payments are handled by our payment provider. We never receive your full card details.
  • If a payment fails we will retry it and tell you. If it keeps failing, the workspace moves to a limited state described in clause 8 rather than being deleted.
  • We may change prices with at least 30 days' notice before your next renewal. You may cancel before then.

6. Cancelling

You may cancel at any time from the billing page. The workspace continues until the end of the period you have already paid for, then stops renewing. We do not refund part-periods unless the law requires it or we have failed to provide the service.

7. Availability

We aim to keep WaryMail available and will give notice of planned maintenance where we reasonably can. Unless a separate written agreement says otherwise, the service is provided without a specific availability commitment or service credit. WaryMail also depends on your mail provider: an outage or a policy change at Google, Microsoft or your IMAP host can stop parts of the service working, and that is outside our control.

8. Suspension and expiry

If your subscription lapses, the workspace becomes limited — you can still sign in, read and export your data, but sending and syncing stop. We keep your data for the period stated in the privacy policy and then delete it. We will tell you before deletion.

9. Ending the agreement

  • Either of us may end this agreement at any time; yours takes effect at the end of your paid period.
  • We may end it immediately for a serious or repeated breach of these terms or the acceptable use policy, or if required by law.
  • On termination you may export your data during the retention period described in the privacy policy.

10. Warranties and liability

We provide the service with reasonable skill and care. Beyond that, and to the extent the law allows, the service is provided “as is”: we do not warrant that it will be uninterrupted, error-free, or that tracking information is complete or accurate.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, neither of us is liable for indirect or consequential loss, loss of profit, or loss of business, and our total liability in any twelve-month period is limited to the fees you paid us in that period.

11. Data protection

Where we process personal data on your behalf we do so as your processor, on the terms in the data processing information, which forms part of this agreement.

12. Changes to these terms

We may change these terms. For material changes we will give at least 30 days' notice by email or in the application; continuing to use the service after that means accepting them. If you do not accept a material change you may cancel and we will refund any period you have paid for but not used.

13. General

  • You may not transfer this agreement without our consent. We may transfer it as part of a sale or reorganisation of our business, on notice to you.
  • If any clause is unenforceable, the rest continues to apply.
  • These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
